Patrick A. Malone (born 1951) is a trial lawyer and author living in Washington, D.C. Malone co-developed an experimental advocacy method called "Rules of the Road".

Advocacy Method

Malone wrote the Road Rules: The Plaintiff's Lawyer's Guide to Proven Responsibility , with Rick Friedman, published by Trial Guides in 2006. Since then, the techniques described in this book have become the subject of national seminars and regional lawyers for courts, sponsored by the American Association of Justice (AAJ) - formerly known as the American Trial Lawyers Association (ATLA) - the largest organization for plaintiffs lawyers in the United States). The second, expanded edition of this book was published in 2010. The publisher described the book as "America's best-selling text on proof of liability." The phrase "Rules of the Road" has been given a trademark.

In their book, Friedman and Malone assume that civil defendants overcame a lawsuit with three major techniques - "complexity, confusion and ambiguity" - and that plaintiffs plaintiffs can prepare more persuasive cases by developing specific "rules" of cases that explain core responsibility problem in this case.

In 2012, Malone is the lead author of a follow-up book, Winning Medical Malpractice Cases With Road Engineering Rules . In the same year, AAJ added a special two-day annual seminar on "road rules" as applied to medical malpractice cases.

In 2016, Malone's book The Farnless Cross-Examiner: Win the Witness, Win the Case was published. This book aims to undo standardized suggestions on how trial lawyers should cross-examine and instead advocate a more analytical and adaptable approach.

Famous cases

In Benedi v. McNeil-PPC, Inc. The federal jury in Alexandria, Virginia, discovered in 1994 that Tylenol producers had to pay Malone $ 8 million clients for failing to warn her label about the drug's ability to break the liver in the usual doses of alcohol drinkers. The ruling was affirmed by The Fourth Circuit The Boston Globe called it one of ten lawsuits over pharmaceutical companies.

In Semsker v. Lockshin, a state court jury in Rockville, Maryland, presented a family of $ 5.8 million lawyers to a dermatology practice that failed to diagnose a lawyer melanoma on time. The trial court agreed with Malone's argument that state restrictions on malpractice malpractice should not apply to this case. However, the state supreme court, the Maryland Court of Appeal, reversed and ordered the verdict reduced to take into account the legal cap after hearing of the amici curiae, including the state medical community and the American Medical Association.

Malone represents the plaintiff at Goldberg v. Boone , Maryland medical malpractice in which the plaintiff suffered a brain injury during a procedure to remove cholesteatoma from the ear. Reversing the mid-level appeals court, the Maryland appeals court agreed with Malone's position and set the right of Maryland patients to demand surgeons for lack of informed consent for not informing them that more experienced surgeons were available for certain procedures.

Careers

Prior to studying at law school, Malone was a medical writer and investigative reporter for the Miami Herald. He was a finalist for the 1980 Pulitzer Prize for "Dangerous Doctor", a series of articles he co-authored. He earned a J.D. degree from Yale Law School in 1984.

Malone was a lawyer for Judge Gerhard Gesell of the US District Court for the District of Columbia from 1984 to 1985. Malone worked for 22 years for Stein, Mitchell & Mezines (now Stein, Mitchell, Muse & Cipollone, LLP).

Malone also wrote The Life You Save: The Nine Steps to Finding the Best Medical Treatment - and Avoiding the Worst , which helps patients and their friends and family ensure that they receive the best medical care in today's healthcare system.
